Industry Access Ltd, trading as Industry Access, is a company registered in England and Wales (Company Number: 16552060) with a registered address of Glebe Business Park, Mitchell Charlesworth Accountants, Lunts Heath Road, Widnes, England, WA8 5SQ ("we", "our", "us" in this privacy statement).

Industry Access is responsible for collecting, processing, storing and safekeeping personal and other information as part of providing our membership platform, mobile app and associated services. We manage personal information in accordance with data protection legislation including the Data Protection Act 2018 and the UK General Data Protection Regulation (UK GDPR). We are registered as a Data Controller with the Information Commissioner's Office.

1. Data Processing Principles

We take protecting your privacy and data security seriously. Please read this statement carefully as it sets out our approach to processing personal data, what information we may collect, how we may use, store and protect it, and your rights as a data subject.

We are guided by the following principles when processing data:

• We will only collect data for specific and specified purposes
• We will not collect data beyond what is necessary to accomplish those purposes
• We will collect and use your personal information only if we have sensible business reasons for doing so, such as delivering our membership platform and services
• We will not use your data for purposes other than those for which it was collected, except as stated within this policy or with your prior consent
• We will apply high technical standards to make our processing of data secure
• We will not store data in identifiable form longer than is necessary to accomplish its purpose or as required by law
• We will not give consent for your information to be used by third party service providers for the training and development of AI modelling software or similar purposes

2. How We Collect and Use Personal Data

Most personal information is provided directly and voluntarily by you when you engage with us. We will collect information from you when:

• You purchase a membership through our website or app
• You complete our checkout form, including providing your Spotlight profile link
• You sign up to our mailing list or waitlist
• You contact us by email or through our app
• You post within our community app channels
• You submit feedback via our post-session feedback form
• You visit our website (technical data collected automatically via cookies)

We collect this information in order to:
• Process and manage your membership and provide access to the platform and app
• Process your monthly subscription payment securely
• Send you booking confirmations, Zoom links, session reminders and other operational communications
• Provide your Spotlight profile link to industry professionals ahead of sessions you have booked
• Operate and moderate the community app
• Collect and analyse feedback to improve our platform and sessions
• Contact you regarding your membership, including payment issues and cancellation
• Send win-back communications if you cancel your membership
• Notify you about changes to our services
• Monitor and improve our website and app through analytics

We will not sell or lend your personal data to third parties, or share your personal data for marketing purposes without your express consent. We will only share your personal data with third party service providers where it is necessary for the delivery of our services, and only where we are confident that such providers have appropriate data protection systems and measures in place compliant with UK Data Protection Legislation.

3. What Information We Collect

In accordance with Data Protection Legislation we only collect and process information which we require to meet the specific purposes stated above. The information we may collect about you includes:

• Identity data: your full name
• Contact data: your email address
• Professional data: your Spotlight profile link • Transaction data: payment records. Card details are processed securely by our payment provider and are not stored by us.
• Usage data: how you interact with the platform, your booking history, session attendance and feedback
• Community data: posts and messages within the Industry Access app
• Technical data: IP address, browser type, device information and pages visited, collected automatically when you use our website

4. How We Store Your Information

We have in place appropriate technical and organisational measures to ensure the security, confidentiality, integrity and availability of personal data we control. Your information is securely stored on our Kajabi membership platform, which is not publicly accessible and is password protected. Access is restricted to authorised personnel only.

We may store or process your data on cloud-based platforms whose servers are based outside of the UK. We will only use such third party service providers where we are confident that appropriate safeguards are in place to ensure personal data is subject to an equivalent level of security and protection as required under UK Data Protection Legislation.

We have appropriate procedures in place to handle any potential personal data breaches, in accordance with Data Protection Legislation. Any such breaches will be reported to the relevant supervisory authority and notified to affected data subjects where we are legally required to do so.

We will only keep your personal data for as long as is necessary to meet the requirements for which it was collected:

• Active member data: retained for the duration of your membership
• Cancelled member data: retained for 12 months after cancellation, then securely deleted
• Payment records: retained for 7 years in line with HMRC requirements
• Q&A recordings: deleted 30 days after upload
• Website analytics data: retained in accordance with the analytics provider's standard retention periods

5. Legal Basis for Processing Your Data

The UK GDPR provides that processing of your data shall only be lawful if at least one of the following applies:

• You have consented
• For the performance of a contract
• For compliance with a legal obligation which we must perform
• To protect the vital interests of you or another person
• It is in the legitimate interests pursued by us or a third party

Specifically, we rely on the following bases:

• Contract: to deliver your membership and the services you have paid for
• Legitimate interests: operational communications, platform improvements and win-back emails
• Consent: where you have ticked the Q&A recording consent checkbox at checkout, and where you have accepted non-essential cookies
• Legal obligation: where we are required by law to process or retain data

6. Sharing Your Data

We share your personal data only in the following limited circumstances:

• With industry professionals (facilitators): your name and Spotlight profile link are shared 24 hours before a session you have booked. No other personal data is shared. Facilitators may not retain this information after the session.
• With our platform provider: who hosts the membership platform and app on our behalf
• With our payment provider: who processes subscription payments securely
• With our booking and automation service providers: who manage session bookings and data flows between our systems on our behalf
• With legal or regulatory authorities: where required by law

We will not give consent to third party service providers to use your information, including audio and video recordings, for purposes other than those for which the information was collected. We will not give consent for your information to be used for the training and development of AI modelling software or similar purposes.

7. Recordings

Industry Q&A sessions and guest expert sessions are recorded with your consent, which you provide at checkout. Recordings are made available to all active members for 30 days after each session for catch-up purposes and are then permanently deleted.

Industry workshops (3-hour sessions) are never recorded under any circumstances.

8. Your Rights

Under UK GDPR you have the right to:
• Access: request a copy of the personal data we hold about you
• Rectification: request correction of inaccurate or incomplete data
• Erasure: request deletion of your personal data in certain circumstances
• Restriction: request that we limit how we use your data
• Portability: request your data in a portable, machine-readable format
• Object: object to processing based on legitimate interests
• Withdraw consent: where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing

We use website analytics to provide the best user experience and to evaluate and improve our site. We may utilise third party analytics services to monitor website behaviour and navigation. These providers collect information using cookies in accordance with their own privacy policies. Information collected may include:

• Number of visitors to our site

This information is almost always anonymised and aggregated before being reported to us. We do not use this data to present targeted advertising. Industry Access products are ad-free.
